Proposed Ballots Comments:
2003.01 - Estimated Distance Texas Comments 
WA: The language of the ballot for Plan Section 801 poses administrative problems. “Determine distance reported for the preceding year” might refer to distance on applications filed during a preceding year for a coming registration year. But that reported distance itself is from a prior preceding year. The preceding year contains portions of two registration years that causes problems when determining the number of vehicles accruing such distance reported. There is also a problem about identifying or defining “replacement” vehicles. The problem of matching vehicles and distance push the figure for Plan Section 801.4 close to being a random number
2003.02 - Peer Review WA: We disagree with the set one-year review being dropped in favor of a review period at the favor of the Peer Review Committee.

2003.04 - Article III Texas Comments

2003.05 - Article I WA: Plan Section 110 is missing some text in the ballot that requires the same clarification as made in the Official Commentary.
2003.06 - Article IV WA: The sentence that replaces the paragraph that mentions Article III in Plan Section 402 is simply a restatement of the first proposed addition in this proposed Plan Section.
2003.07 - Article V Texas Comments 
WA: The committee should decide on which of the two terms used, “[the] registration” (proposed) or “cab card” (current Section 502), should be used consistently.
2003.08 - Article VI WA: Some possible conflicts might occur between the prior fees of proposed Plan Section 308 and the remainder fees mentioned here.
2003.09 - Article VII WA: If a jurisdiction requires a signed cab card to the purchaser to transfer weight credits, the selling registrant can neither return the cab card nor certify its destruction.
2003.10 - Article X  
2003.11 - Article XI WI: "Should put the new definitions in alphabetical order. This will mean renumbering everything after "R", but that should be done."
WA: In regards to Proposed Section 294, leasing has ownership implications while renting does not. They are not interchangeable terms nor should they be linked so by a definition.

2003.14 - Article XIV WA: Proposed Section 1404 is too close to our Temporary Authority language.
2003.15 - Article XV WA: Proposed language for Section 1502 loses the concept of inadequate records that is referred to in Article XVII and APM 600.
2003.16 - Article XVI WA: The second proposed paragraph should keep the concept of “perform a number of audits” to be clear.

2003.19 - Dispute Resolution WI: "There is nothing in the ISTEA mandate or in the IRP Plan that requires a member jurisdiction to be a member of IRP Inc and thus pay dues. There is no authority for IRP Inc to authorize other jurisdictions to suspend distribution of fees under 2304 (a)(4)."

Texas Comments 
WA: It is curious that when a federal court chastises the DRC for not following established rules that meant to control the actions of the committee, IRP responds by removing restrictions on the committee actions.

2003.21 - Owner Operator WI: "Section 906 add "2b State/provincial tax filings, if any"

906 PLACE OF BUSINESS

1. Driver's license;

2. National tax filings, if any;

2b State/provincial tax filings, if any

3. Local tax filings, if any;

4. Voter registration information, if any;

5. Signature of owner-operator on the application for apportioned registration,

affirming that the operational records are available upon request; and

6. Any other pertinent information the base jurisdiction deems necessary."

Owner-Operator Independent Driver Association Comments 

2003.22 APM Section 400 WA: This might be an inappropriate place to require new records from the registrant. Monthly and quarterly summaries are not necessary to trace vehicle movements (per the APM) -- the current requirement under Plan Section 1501.
2003.23 APM Section 700 WA: We have no objection to the change, however, if Proposed Ballot 2003.22 passes, the reference to APM Section 402 would be incorrect.
